Terms of Service

By accessing or using any part of the Cyber Range you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

Cyber Range Poulsbo is a collection of services for cybersecurity and computer science education designed for use by educators and students in Washington State secondary schools, colleges, and universities. At times, Cyber Range Poulsbo may be available to select non-school organizations and out-of-state institutions for education, research, and collaboration purposes.

These Terms of Service govern the access and use of Cyber Range Poulsbo (“Cyber Range” or “Services”), including its systems, networks, interfaces, software, and any content, materials, tools, features, and functionality (“Resources”) accessible from or made available through the Services. Cyber Range Poulsbo is managed by Western Washington University, 516 High Street, Bellingham, WA 98225 (referred to as “University”, “us”, “we”). Any reference to “you” or “your” mean you as a user of the Services.

By using the Services or contributing to its Resources, you agree and consent to these Terms of Service, including terms that limit our liability or affect your legal rights, any referenced and incorporated guidelines and policies, and any additional terms specific to your particular use of the Cyber Range which become part of your agreement with us (collectively, the “Terms”). If you are using the Cyber Range on behalf of an organization, you represent to us that you have the authority to bind that organization or entity to these Terms, and the organization accepts these Terms.

You understand that the Cyber Range is provided solely for cybersecurity and computer science educational purposes and may not be used for any other activity or purpose.

Accepting the Terms

The Terms explain how you may use the Cyber Range and any content made available on it. By using the Cyber Range, you agree to be bound by and comply with these Terms. If you do not agree with any of the Terms, you should not access the Cyber Range.

Account and Password Security

You must have an account to access the Cyber Range. You must use your school-issued email to register for an account. Select non-school organizational users will use their organizational email address to register. Teachers and schools will facilitate account provisioning on behalf of students. You are responsible for making sure that your account details are kept secure and confidential. If we have reason to believe a breach of security or misuse of the Cyber Range is likely through your account, we may suspend or terminate your account.

Restrictions on Your Use of the Cyber Range

The Cyber Range is for cybersecurity educational purposes only. You must not use the Cyber Range for business purposes nor provide access to the Cyber Range through your account to any other person. 

As a condition of using the Cyber Range, you agree that you may not or attempt to:

  • misuse or attack the Cyber Range by introducing malicious or technologically harmful material to the Cyber Range, other users, or the communications networks and infrastructure used to access and make available the Cyber Range. 
  • attempt to gain unauthorized access to the Cyber Range, or any server, computer, database, or component connected to the Cyber Range. 
  • engage in any unlawful, inappropriate, or abusive use of the Resources made available on the Cyber Range. We may prevent or suspend your access to the Cyber Range if you fail to comply with the Terms or any applicable law.

 

Ownership, Use and Intellectual Property Rights 

Use of the Cyber Range does not give you ownership of any intellectual property rights in the Cyber Range or any of the content you may access. 

You may contribute and designate teaching and learning materials (Resources, e.g., instructional content, customized virtual machines, and network environments) as private or as an Open Educational Resource that permits free use, adaptation, and sharing to the greater Cyber Range Poulsbo community of users (“Community”).

Logos, graphics, trademarks, service marks are the property of their respective owners.

Any feedback, comments, suggestions you may provide to the University or Cyber Range is entirely voluntary. We are free to use any feedback, comments, or suggestions as we see fit and without obligation to you. 

Community Resource Guidelines

To the extent you elect to contribute any Resource to the Community, you confirm that all content contained in the Resource complies with these Terms, that you are either the original owner of the Resource you submit, or that you have the necessary rights and permissions to irrevocably contribute the Resource and share it with the Community. 

You understand that upon submitting any Community Resource, the Resource is shared for review by the University and its partners. By contributing a Community Resource, you are contributing to the effort to raise the quality of cybersecurity curriculum available to educators.

While you retain ownership rights in the original material contained in the Resource, when you submit a copy of the Resource, you give the University (and those we work with) irrevocable rights to publicly display and distribute all content contained in the Resource.

You further agree that you will not knowingly contribute any sample to the Cyber Range that contains confidential or commercially sensitive data or personal data of any individual without lawful permission.

You are solely responsible and liable for ensuring your contributed content does not infringe on the rights of any third parties and indemnify us against any claims, damages, losses, and expenses resulting from a claim or action.

Uptime of Service

We do not guarantee the Cyber Range, or any content on it, will be always available or be uninterrupted. We may from time to time suspend, withdraw, or restrict the availability of all or any part of the Cyber Range for operational reasons, maintenance reasons or other reasons.

Data Collection and Your Privacy

Your privacy is important to us. Cyber Range Poulsbo’s Privacy Policy explains how we treat and protect your personal data and is incorporated into these Terms by reference. Please read the Privacy Policy for information on the collection, use, and disclosure of your personal data. 

While respecting confidentiality and privacy, the University reserves the right to examine all computer systems and electronic resources contained within the Cyber Range. 

You understand and agree that the University may remove or demand removal of any data or other information that is provided, transmitted, maintained, or stored through Cyber Range to ensure on-going compliance with any applicable use policies and/or address inappropriate, unlawful, offensive, or obscene material. 

The Family Educational Rights and Privacy Act (FERPA) affords students certain privacy rights with respect to their education records. Users are required to maintain compliance with FERPA. The Cyber Range shall comply with the requirements of FERPA and shall only disclose student education records to the extent authorized under FERPA. 

The University may use all data, in whole or in part, for purposes of providing the Services and for research, analysis, development, enhancement and improvement of the Cyber Range. 

The University may access your account for troubleshooting and related service purposes. 

The Cyber Range will comply with, and respond to, all validly issued legal processes, including subpoenas.

Hyperlinks and Third-Party Tools

The Cyber Range may include materials and links or references to third-party websites. We have no control over third-party websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third-party site does not mean that we endorse that third party's website, products, or services. Your use of a third-party site may be governed by the terms and conditions of that third-party site and use is at your own risk.

Limitation of Liability

Our software, website, educational materials, supporting tools and information are provided on an “as is” basis and, other than expressly set out in the Terms, without warranties of any kind, either express or implied, all of which are expressly disclaimed. Although we are striving to provide you with a quality cyber range, we do not warrant that our Services will be secure, timely, error-free, without bugs or mistakes and/or will be uninterrupted, nor do we warrant that the Cyber Range will meet your requirements or expectations, or that after using the Cyber Range you will have sufficient skills and knowledge to avert cyberattacks. 

In no event shall the University be liable to you for any loss or damage under or in relation to this Agreement. You acknowledge and accept that this exclusion is fair and reasonable in exchange for making its services and resources available to you.

Acceptable Use

Cyber Range Poulsbo reserves the right to suspend or terminate your use of the Services if you breach these conditions, including our Acceptable Use Policy.

Governing Law

The laws of the State of Washington apply to this Agreement. The venue for any action shall be the Superior Court for Whatcom County, Washington.

Severability

If any provision of the Terms is held to be invalid or unenforceable, the remaining provisions of the Terms will remain in full force and effect.

Modification

We reserve the right to update and amend these Terms from time to time. Our updated Terms will be displayed on the Cyber Range and by continuing to access and use the Services following such changes, you agree to be bound by any modifications.
